STATUTORY OVERVIEW

TDS & TCS Withholding Tax Management

Tax Deducted at Source (TDS) and Tax Collected at Source (TCS) represent the primary revenue withholding mechanism under the Income-tax Act, 2025, operating alongside transitional compliances under the Income-tax Act, 1961. The statutory scope has been consolidated under Section 393 and transaction schedules of the 2025 Act (subsuming legacy provisions like Sections 194C, 194J, 194I, 194Q, and 194R). Non-compliance triggers statutory disallowance of business expenditures (formerly Section 40(a)(ia)), mandatory interest (formerly Section 201(1A)), and daily late filing fees (formerly Section 234E). Our withholding tax practice assists corporate deductors, firms, and organizations in executing accurate calculations, timely challan deposits, and prompt return filings.

FREQUENTLY ASKED QUESTIONS

Statutory FAQs & Practical Guidance

Frequently asked questions and procedural guidance regarding TDS & TCS Withholding Tax Management.

What happens if TDS is deducted but not deposited by the 7th of the following month?
Under Section 201(1A), interest is charged at 1.5% per month (or part of a month) from the date of deduction to the date of actual payment into the government account. Additionally, if the tax is not deposited before the due date of filing the income tax return, 30% of the corresponding expenditure is disallowed under Section 40(a)(ia).
What is the late filing fee under Section 234E for delayed quarterly TDS returns?
Under Section 234E, a statutory fee of ₹200 per day is payable for every day during which the failure to file the TDS/TCS statement continues. The total late filing fee cannot exceed the total amount of tax deductible or collectible for that quarter.
When does Section 194Q (TDS on purchase of goods) apply over Section 206C(1H) (TCS on sale of goods)?
Section 194Q takes precedence over Section 206C(1H). If the buyer's turnover in the preceding financial year exceeded ₹10 Crores and purchases from a resident seller exceed ₹50 Lakhs in the current year, the buyer must deduct TDS at 0.1% under Section 194Q. In this scenario, the seller is not required to collect TCS under Section 206C(1H).
How can a vendor request lower or nil tax deduction?
A payee can make an electronic application in Form 13 on the income tax portal under Section 197 requesting the Assessing Officer to issue a Certificate for Lower Deduction or Nil Deduction. Once issued, the deductor can withhold tax at the lower rate specified in the certificate upon verifying its validity on TRACES.
