02Week 2

Section 17(5) & Rule 42/43 Modeling

Segregating non-creditable purchases under Section 17(5), formulating mathematical algorithms for proportionate monthly reversals under Rule 42/43 for mixed supplies.

03Week 3

Mandatory ISD & Cross-Charge Structuring

Structuring the mandatory Input Service Distributor (ISD) framework under amended Section 20, securing separate ISD registration, and drafting inter-branch SLAs.

04Week 4

Bill-to Ship-to Protocols & Ongoing Compliance

Implementing Section 10(1)(b) Bill-to Ship-to drop-shipment standard operating procedures, configuring GSTR-6 filing, and establishing job-work ITC-04 monitoring.

Input Tax Credit Eligibility & Section 17(5) Reviews

Practice Scope & Statutory Guidance

Input tax credit represents one of the most critical drivers of operating cash flow. We conduct rigorous reviews of inward procurement ledgers to ensure credit eligibility under Section 16 while segregating blocked credits under Section 17(5) (such as motor vehicles, works contract services for immovable property, employee welfare perquisites, and lost or destroyed inventory). We also establish automated mechanisms for proportionate credit reversals under Rules 42 and 43 where enterprises execute both taxable and exempt supplies.

Mandatory Input Service Distributor (ISD) & Cross-Charge

Practice Scope & Statutory Guidance

Following amendments under Section 20 enacted via recent Finance Acts, the distribution of common input service credits across multi-locational distinct entities has transitioned to a mandatory ISD mechanism. We evaluate existing head office cross-charge practices, establish separate ISD registration workflows, configure GSTR-6 filing protocols, and structure inter-branch cost allocations in compliance with Rule 28 valuation standards and judicial precedents.

Supply Chain Models & Bill-to Ship-to Structuring

Practice Scope & Statutory Guidance

Modern commerce relies on agile distribution channels including drop shipments, third-party logistics, in-transit sales, and fulfillment center agreements. We assist in structuring transactions under Section 10(1)(b) of the IGST Act (Bill-to Ship-to models), verifying Place of Supply determinations, establishing documentation protocols for job-work movements under Section 143, and mitigating cascading tax impact in high-volume distribution channels.

FREQUENTLY ASKED QUESTIONS

Statutory FAQs & Practical Guidance

Frequently asked questions and procedural guidance regarding Supply Chain Structuring & Input Tax Credit Optimization.

Is Input Service Distributor (ISD) registration mandatory for multi-branch companies?
Yes. Following amendments to Section 20 of the CGST Act introduced by the Finance Act, 2024, the distribution of input tax credit for common services procured by a Head Office from third-party vendors for multi-state branches is now mandatorily required to be routed through an Input Service Distributor (ISD) registration. Cross-charge can no longer be used as a substitute for third-party common service distribution.
What is the valuation rule for inter-branch transactions between distinct persons under Rule 28?
Under Rule 28 of the CGST Rules, the value of supply of goods or services between distinct persons is the Open Market Value. However, under the second proviso to Rule 28, where the recipient branch is eligible for full Input Tax Credit, the value declared in the tax invoice is statutorily deemed to be the open market value, giving management flexibility in inter-unit pricing.
When is Input Tax Credit blocked under Section 17(5) for motor vehicles?
Under Section 17(5)(a), input tax credit is blocked on motor vehicles for transportation of persons having approved seating capacity of not more than 13 persons (including the driver), except when used for specified purposes: (1) further supply of such vehicles, (2) transportation of passengers (commercial taxis), or (3) imparting training on driving such vehicles.
What happens if job-work goods are not received back within the statutory time limit?
Under Section 143(3) and 143(4), if inputs sent for job work are not received back or supplied from the job worker's premises within 1 year (or 3 years for capital goods), it is deemed by law that such goods were supplied by the principal to the job worker on the date they were originally sent out, making the principal liable to pay tax along with interest from the original dispatch date.
