FREQUENTLY ASKED QUESTIONS

Statutory FAQs & Practical Guidance

Frequently asked questions and procedural guidance regarding GST Returns, E-Invoicing & Periodic Compliance.

How is interest calculated under Section 50 for delayed payment of GST?
Under the proviso to Section 50(1) read with Rule 88B, interest at 18% per annum is levied only on the net tax liability paid in cash through the electronic cash ledger (PMT-06 challan) when the return is filed after the due date. However, if tax is paid after the commencement of any departmental proceedings under Section 73 or 74, interest is charged on the gross tax liability.
What is the consequence of not replying to a Form DRC-01B or DRC-01C notice within 7 days?
Under Rule 59(6) of the CGST Rules, if a taxpayer fails to either deposit the disputed tax amount or furnish a detailed electronic explanation in Part B of Form DRC-01B (turnover variance) or Form DRC-01C (ITC variance) within 7 days of notice issuance, the GST portal automatically blocks the taxpayer from filing their subsequent month's Form GSTR-1 or using the IFF facility.
What happens if a recipient fails to pay the supplier within 180 days under Rule 37?
Under the second proviso to Section 16(2) read with Rule 37, if a recipient fails to pay the supplier the invoice value along with the tax within 180 days from the invoice date, an amount equal to the input tax credit availed must be paid by the recipient along with interest at 18% under Section 50. The credit can be reclaimed once the payment is actually made to the vendor.
Can a filed Form GSTR-1 or GSTR-3B return be revised under GST law?
No. GST law does not provide for the filing of revised returns. Any error, omission, or adjustment (such as debit/credit notes, value corrections, or amendment of invoice details) must be reported in the subsequent tax period's return in the designated amendment tables, subject to the statutory cutoff date (30th November following the end of the financial year).
