Zero-Rated Supplies & Export Refunds (Goods & Services)

Practice Scope & Statutory Guidance

Under Section 16 of the Integrated Goods and Services Tax Act, 2017, exports and supplies to SEZ entities qualify as zero-rated supplies. Exporters can execute supplies either under Letter of Undertaking (LUT) without payment of IGST and claim refund of accumulated unutilized ITC under Rule 89, or make export shipments with payment of IGST and seek automated rebate claims through ICEGATE and GST portal integrations. We formulate the computation dossiers, reconcile Shipping Bills / Bills of Export with Form GSTR-1, and compile Foreign Inward Remittance Certificates (FIRC) / BRC documentation for service exports.

Inverted Duty Structure Refunds under Rule 89(5)

Practice Scope & Statutory Guidance

Where the tax rate on inputs is higher than the tax rate on outward taxable supplies (other than fully nil-rated or exempted supplies), businesses accumulate substantial unutilized ITC. Under Section 54(3)(ii) read with the revised formula under Rule 89(5), we calculate the Maximum Refund Amount, ensuring precise segregation of input goods versus input services and capital goods, and reconcile inward supply registers against Form GSTR-2B to prevent claim rejections.

Deficiency Memos, Notices & Hearings

Practice Scope & Statutory Guidance

Upon submission of Form GST RFD-01, tax authorities examine claims under Rule 90. In instances where a Deficiency Memo in Form GST RFD-03 or a Show Cause Notice in Form GST RFD-08 is issued, we formulate detailed legal replies, collate substantiating annexures, and represent the taxpayer during personal hearings under Rule 92.

FREQUENTLY ASKED QUESTIONS

Statutory FAQs & Practical Guidance

Frequently asked questions and procedural guidance regarding GST Refunds & Inverted Duty Drawbacks.

Can refund of Input Tax Credit on Capital Goods be claimed under Inverted Duty Structure?
No. Under Section 54(3) of the CGST Act, refund of unutilized Input Tax Credit under Inverted Duty Structure is strictly restricted to credit accumulated on 'inputs' (goods used in production). ITC on capital goods and input services cannot be claimed as refund under the inverted duty formula under Rule 89(5).
What is the time limit for filing a GST refund application?
Under Section 54(1), an application for GST refund must be filed before the expiry of 2 years from the 'relevant date'. The relevant date varies depending on the refund category: for goods exported by sea/air, it is the date of departure; for services exported, it is the date of receipt of foreign currency payment; and for inverted duty structure, it is the due date of furnishing Form GSTR-3B.
What is the Doctrine of Unjust Enrichment in GST refunds?
The Doctrine of Unjust Enrichment presumes that the taxpayer has passed on the incidence of tax to the buyer. To claim a refund directly into their bank account, the claimant must prove through documentary evidence and a Chartered Accountant's certificate (Annexure 2) that the incidence of tax was absorbed by the claimant and not passed on to the customer or any third party.
What should I do if the tax officer issues a Deficiency Memo in Form GST RFD-03?
Under Rule 90(3), when a Deficiency Memo (RFD-03) is issued, the original refund application is closed and the unutilized ITC that was debited at the time of filing is automatically credited back to your electronic credit ledger. The taxpayer must rectify the highlighted defects and submit a completely fresh refund application in Form GST RFD-01.
