FREQUENTLY ASKED QUESTIONS

Frequently Asked Questions on Indirect Taxation

Expert answers on GST registrations, input tax credits, e-invoicing thresholds, and appellate remedies under the CGST Act.

What is the statutory threshold for mandatory GST registration?
Under Section 22 of the CGST Act, registration is mandatory for suppliers of goods whose aggregate turnover in a financial year exceeds ₹40 Lakhs (₹20 Lakhs in Special Category States). For service providers or mixed suppliers, the threshold is ₹20 Lakhs (₹10 Lakhs in Special Category States). Under Section 24, registration is compulsory regardless of turnover for inter-state suppliers of goods, e-commerce vendors, and entities liable under reverse charge (RCM).
What is the difference between Form GSTR-2A and Form GSTR-2B for claiming ITC?
Form GSTR-2A is a dynamic, continuously changing read-only view that updates whenever a supplier uploads an invoice. Form GSTR-2B is a static, time-bound statement generated on the 14th of every month. Under Section 16(2)(aa) read with Rule 36(4), taxpayers are statutorily required to claim Input Tax Credit strictly based on Form GSTR-2B for that specific tax period.
Who is required to generate E-Invoices under Rule 48(4)?
Electronic invoicing is mandatory for registered businesses whose aggregate annual turnover in any preceding financial year from 2017-18 onwards exceeds ₹5 Crores. Qualified businesses must report all B2B invoices, credit notes, and debit notes to an authorized Invoice Registration Portal (IRP) to generate a unique IRN and QR code.
What are the remedies available against an adverse GST order under Section 73 or 74?
If an adjudicating authority passes an unfavorable assessment or demand order under Section 73, 74, or 74A, the taxpayer has a statutory right to file a First Appeal before the Commissioner (Appeals) under Section 107 within 3 months (extendable by 1 month) upon pre-deposit of 10% of disputed tax. Subsequent appeals lie before the Goods and Services Tax Appellate Tribunal (GSTAT) under Section 112.
